3. AI Processing & Third-Party Services

Your content may be processed by third-party artificial intelligence systems.

You acknowledge:
– AI systems are external and may operate independently
– Outputs may be inaccurate, incomplete, or biased
– Gubry does not control how third-party AI models internally process data

By using the App, you consent to this processing.

4. Data Use for Business & AI

All content and interactions:
– May be stored indefinitely
– May be used for AI training, analytics, and product development
– May be used for commercial purposes including monetization, marketing, and derivative works

This use may continue even after account deletion to the extent permitted by law.

5. Data Sharing

We may share data:

– With service providers such as hosting, analytics, and AI platforms
– To comply with legal obligations
– To protect rights, safety, or platform integrity
– In connection with mergers, acquisitions, or business transfers
We do not guarantee that third parties will apply identical protections.

6. Data Retention

– Operating the App

We may retain data indefinitely where permitted by law.

To the maximum extent permitted by law, Gubry is not liable for such events except where required by law.

8. Public Content & Visibility

Content you submit may be:
– Publicly visible within the App
– Used in AI outputs
– Stored and reused internally

You assume all risks associated with public posting.

9. Age Restriction

The App is strictly for users 14 years or older.

If we determine that a user is under 14, we may:
– Deny access
– Delete the account
– Remove associated data

10. Your Rights

Where required by law, you may request access, correction, or deletion of your data.
We may deny requests where permitted by law.

11. Changes

Gubry may update or modify this Privacy Policy at any time.

– Updates will be effective upon posting within the App
– Your continued use of the App after changes constitutes acceptance of the updated Privacy Policy
– It is your responsibility to review this Privacy Policy periodically

For material changes, Gubry may, but is not obligated to, provide additional notice.

12. User Content License

By submitting, posting, or uploading content to the App, you grant Gubry a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, sublicensable license to use, host, store, reproduce, modify, adapt, publish, distribute, display, create derivative works from, analyze, commercialize, and otherwise exploit such content in connection with operating, improving, promoting, training AI systems, developing technologies, and expanding the App and related services.

You represent and warrant that you have all necessary rights to grant this license.

13. Disclaimer of Warranties

The App, AI systems, and all related services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied.

To the maximum extent permitted by law, Gubry disclaims all warranties including but not limited to:
– merchantability
– fitness for a particular purpose
– non-infringement
– accuracy
– reliability
– availability
– security

Gubry does not guarantee uninterrupted operation, error-free functionality, or accuracy of AI-generated outputs.

14. Limitation of Liability

To the maximum extent permitted by law, Gubry, its owners, operators, affiliates, employees, contractors, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to:

– use of or inability to use the App
– AI-generated outputs
– user-generated content
– moderation actions
– account suspension or termination
– data loss
– security incidents
– third-party services

In no event shall Gubry’s total liability exceed the amount paid by you, if any, within the previous 12 months.

15. Account Suspension & Termination

Gubry may suspend, restrict, terminate, or remove accounts, content, or access to the App at any time, with or without notice, for any reason or no reason, including suspected violations, abuse, harmful conduct, legal risk, or operational reasons.

Gubry is not liable for any losses resulting from such actions.

16. Governing Law

These terms and this Privacy Policy shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.

Any disputes arising from or relating to the App shall be resolved exclusively in courts located in New York, USA.

17. Arbitration & Class Action Waiver

To the maximum extent permitted by law, any disputes arising from or relating to the App, services, AI outputs, or this Privacy Policy shall be resolved through binding individual arbitration in New York, USA, and not through court proceedings except where prohibited by law.

You waive any right to participate in class actions, class arbitrations, or representative actions.

18. No Professional Advice

Content, debates, comments, and AI-generated outputs available through the App are for informational and entertainment purposes only and do not constitute legal, medical, financial, psychological, therapeutic, or professional advice.

Users are solely responsible for their decisions and actions.

19. Content Moderation

Gubry reserves the right, but not the obligation, to monitor, review, remove, restrict, or moderate any content, account, or activity at its sole discretion.

Gubry is not responsible for user-generated content or for failing to remove content.
